3.      Minutes, Sign-In Sheet, and Meeting Summary from the June 24, 2005 Meeting – ATTACHMENTS

 

      The minutes, sign-in sheet, and meeting summary from the June 2005 meeting are attached.

 

      Staff Recommendation:    Approve the June 2005 minutes.

 

 

4.   Staff Reports – ATTACHMENTS

 

      Employee Staff Reports from the Managing Director, the Management Assistant, and the Transportation Project Specialist for July, August, and September are attached.

 

      Staff Recommendation:   Accept the reports.

 

 

5.   Cooperative Agreement with the Contra Costa Transportation Authority (CCTA) for Transportation Fund for Clean Air (TFCA) and Measure C Funds for FY 05-06 – SEPARATE ATTACHMENT

 

Annually, WCCTAC and CCTA sign a Cooperative Agreement for TFCA and Measure C funds to implement the Transportation Demand Management Program and for Administrative Oversight.  Pertinent sections of the FY 05-06 Agreement are attached and the Cooperative Agreement is under review by WCCTAC’s Advising Attorney.

 

Staff Recommendation:   Following approval by WCCTAC’s Advising Attorney, authorize the Chair to sign the Cooperative Agreement.

 

 

6.      Consulting Services for MACK5 – ATTACHMENT

 

MACK5 is providing construction management and oversight services during the planning and construction phases of the Richmond Transit Village station building project.  MACK5’s original Professional Services Agreement has expired, and a new Agreement is attached.  Changes include the term of the Agreement and a revised, lower funding amount (since invoices have been submitted for the past twelve months).  Funding for these consulting services was provided by the Richmond Redevelopment Agency in 2004.  There is no fiscal impact to the WCCTAC budget.

 

Staff Recommendation:   Following final approval of the Scope of Work for this phase of the consultant work and approval by WCCTAC’s Advising Attorney, authorize the Chair to sign the Agreement.

 


 

 

7.   Subregional Transportation Mitigation Fee (STMP) Transfer for Consultant Costs

 

At the June 2005 meeting, the Board approved a contract with Michael Bernick for FY   05-06 in an amount not to exceed $45,000 using STMP fees from the Richmond Intermodal Station project.  Maze and Associates, WCCTAC’s auditing firm, has recommended that WCCTAC receive a cash advance from the Contra Costa Transportation Authority for the STMP fees.  Therefore, staff is recommending that a cash advance request be submitted to CCTA for the first six months of the fiscal year ($22,500).

 

Staff Recommendation:  Approve the request to submit a cash advance request to CCTA for STMP fees for the Richmond Intermodal Station project in the amount of $22,500.

 

 

8.      Invoice for the El Cerrito BART Parking Structure Project Using Subregional Transportation Mitigation Fee (STMP) Revenues – ATTACHMENT

 

Attached is the second invoice for the El Cerrito BART Parking Structure Project submitted by the City of El Cerrito which includes attorney’s costs, copying costs, staff time, and the City’s share of the environmental work.

 

Staff Recommendation:  Approve the request by the City of El Cerrito in the amount of $63,689.41 and authorize the Managing Director to submit the invoice to CCTA for reimbursement.

 

 

9.      Letter of Support for AB 1623 – ATTACHMENTS

 

AB 1623 (Klehs), which was recently passed by the legislature and is on the Governor’s desk for consideration, would allow the governing boards of specified transportation agencies to impose an annual fee of up to $5 on motor vehicles registered in the county for the “management of traffic congestion and the mitigation of environmental impacts of motor vehicles within that county.”  See the attached Bill language for additional details.  The Contra Costa Transportation Authority (CCTA) wrote a letter of support for AB 1623 (see attached) and the San Pablo Avenue SMART Corridors project participating agencies have been asked by the Alameda Congestion Management Agency to write a letter of support since the Management and Operations for the project may be an eligible project for funding IF the bill is signed into law.

 

Staff Recommendation:   Authorize the Chair to sign the letter and distribute copies to the appropriate agencies.

 


 

10.        State and Federal Transportation Funding – ATTACHMENTS

 

Attached is information from CCTA regarding the State Transportation Improvement Program (STIP) and the Federal earmarks.  If additional information is available, staff will make a verbal report at the meeting.

11.    Recognition of Participants on the Parchester Elementary School Bus Service Committee

 

The Parchester Elementary School Bus Service Committee has been working to resolve the issue of the students getting to Bayview School for the past eight months or so.  Since the WCCUSD was no longer able to provide a bus via Laidlaw, several donors funded the service through the end of last school year.  At the beginning of this school year, AC Transit changed the route and schedule for Line 71.  The school district is providing AC Transit bus passes for the students and many of them are taking the bus.  While a few minor issues had to be resolved after the start of the school year, the service is working well, and the children have transportation to school.  The following members of the Committee past and present (not in any particular order) should be recognized:  The WCCTAC Board and staff; the WCCUSD Board (particularly Karen Fenton and Dave Brown); the Pinole, Richmond, and San Pablo City Councils; WCCUSD Staff (David Azcarraga and Vince Kilmartin); Bayview School Staff (Merrilee Cavanecia, Gwen McNorton, and Barbara McKinney); Summer Brenner; Nancy Baer and Denise Milosevich from Contra Costa Health Services; AC Transit Planner Robert Del Rosario and other AC Transit planners and staff; San Pablo Public Works Director Adele Ho; Tumani Eaton and Doris Galloway from the Parchester Neighborhood and other parents/guardians/supporters; Cochise Potts; Eddrick Osborne; and funding partners/donors.  (Apologies if a Committee participant was overlooked.)

 

Staff Recommendation:   Acknowledge the time and effort of the Committee and the successful outcome.

12.    Recommendation for Law Firm to Provide Legal Services to WCCTAC for          FY 05-06 – Staff – SEPARATE ATTACHMENT – 15 minutes

 

ACTION ITEM

 

Earlier this summer, a Request for Proposals (RFP) was issued for legal services for WCCTAC and $25,000 was budgeted/approved in FY 05-06.  Five firms responded to the RFP, staff reviewed and scored the responses, and four firms were asked to participate in an interview with the Managing Director, Advising Attorney (Everett Jenkins, Interim City Attorney for Richmond), and Brian Libow (San Pablo’s City Attorney).  The firms interviewed were:  Gibbs & Gonzalez; McDonough, Holland & Allen; Meyers/Nave; and Richards, Watson, Gershon.  Based upon the interviews, the firm of Meyers/Nave is recommended as WCCTAC’s legal firm.

 

The RFP is attached, as is a Staff Report and summary of the Meyers/Nave proposal, including the negotiated rates for attorneys, attorney specialists, and administrative overhead.

 

Mr. Bryan Otake, the lead attorney, will be introduced at the October 28, 2005 meeting.

 

Staff Recommendation:   Based upon the recommendation of the review committee, authorize the Chair to sign a Professional Services Agreement with Meyers/Nave for FY 05-06 (renewable for five years).

 

 

13.        Discussion/Possible Action Regarding I-80 Freeway Congestion – Staff – ATTACHMENTS – 15 minutes

 

ACTION ITEM

 

For the fifth year in a row, the morning commute along I-80 is the most congested stretch of freeway in the Bay Area.  Based upon discussion and direction at the September 15th Technical Advisory Committee meeting, staff prepared the attached “information piece” for Board discussion and potential action.  Staff is seeking direction on how and to whom the “information piece” may be distributed to call attention to the severe congestion issues in and through West County on I-80 and the parallel arterials.

 

TAC/Staff Recommendation:  No recommendation; for Board discussion and action as appropriate.

14.    Proposed Casinos in West County – Regional Transportation Impacts – Staff – VERBAL REPORT – ATTACHMENT – 10 minutes

 

Attendees from the WCCTAC Board (and staff) will report on the September 22nd meeting on “Off-Reservation Impacts of Tribal Casinos.”  A hand-out provided at the meeting is attached.  WCCTAC has been requested to be the lead agency and fiscal agent for the regional traffic study.

 

Staff Recommendation:   No recommendation; Board action/direction as appropriate.

 

 

15.    Update on the Hercules Park & Ride Lot Project and Parking Charges to be Implemented by BART – Carter Mau, BART Staff – SEPARATE ATTACH-MENT – 15 minutes

 

BART Staff will update the Board on the Hercules Park & Ride Lot Project and the parking charges to be implemented in the near future.  There will be a ten-minute presentation followed by five minutes of questions/answers.

16.        Presentation on the West Contra Costa County Diesel Study – ATTACHMENT – Emily Lee, Pacific Institute (and other Committee Members) – 15 minutes

 

Emily Lee will present a summary of the West Contra Costa County Diesel Study.  There will be a ten-minute presentation followed by five minutes of questions/answers.  The Study cover sheet, table of contents, and Executive Summary are attached.  Further information and the full Study are available on the Pacific Institute website at:  www.pacinst.org.
