7. Cooperative Agreement Between WCCTAC, AC Transit, and Ove Arup & Partners for Additional Scope of Work Related to the Richmond Parkway Transit Center – SEPARATE ATTACHMENT
In 2003, WCCTAC and Ove Arup & Partners (“Arup”) entered into a Professional Consultant Services Agreement for a Planning and Conceptual Design Study for the Richmond Parkway Transit Center (“RPTC”) parking garage. The Study was funded 50/50 by WCCTAC and AC Transit. This Study is complete and a preferred alternative recommended, as reported to the WCCTAC Board at the March 2005 meeting.
Several issues related to the RPTC project have arisen in recent meetings. Arup has prepared a Scope of Work to perform the additional scope items in an amount Not To Exceed $75,000. WCCTAC, AC Transit, and Arup will enter into a new Cooperative Agreement (see attached), that will outline the responsibilities of each agency. WCCTAC will provide project administration and oversight and monitor the work of the consultant, while AC Transit will be solely responsible for the funding through Regional Measure 2 funds.
Staff Recommendation: Following final approval by Meyers Nave, authorize the Chair to sign the Cooperative Agreement in substantially the same form as that attached to this Agenda.
8. Amendment #2 to Agreement for Professional Consultant Services with Summer Brenner – ATTACHMENT
Attached is Amendment #2 to the Agreement with Summer Brenner that extends the term of the Agreement to December 31, 2006. The Amendment has been reviewed and approved by WCCTAC’s Advising Attorney and is ready for signature, pending approval by the Board.
Staff Recommendation: Authorize the Chair to sign Amendment #2.
9. WCCTAC Office Schedule for December Holiday Period
Staff is proposing that the WCCTAC offices be closed for the holidays from Wednesday, December 21st through Tuesday, January 3rd, as follows:

10. Update on AB 1623
The WCCTAC Board approved a letter of support for AB 1623 (Klehs) at the September 2005 meeting. This legislation would allow the governing boards of specified transportation agencies to impose an annual fee of up to $5 on motor vehicles registered in the county for the “management of traffic congestion and the mitigation of environmental impacts of motor vehicles within that county.” AB 1623 was vetoed by the Governor.
Staff Recommendation: No recommendation; for information only.
11. Mobility = Independence Conference – ATTACHMENT
On Friday, October 14th, staff attended the Mobility = Independence Conference in Concord. The conference had over 200 attendees, and the agenda is attached. 12. Resolution 05-05 Supporting the Neighborhood House of North Richmond’s Grant Application to Kaiser Permanente for a “HEAL” Grant – ATTACHMENT
Resolution 05-05 supporting the NHNR’s grant for the HEAL Program is attached.
Staff Recommendation: Authorize the Chair to sign Resolution 05-05.

13. Next WCCTAC Board Meeting – Staff/Chair – 5 minutes
ACTION ITEM
Because of the holidays, the November and December WCCTAC Board meetings are combined into one meeting in early December. Staff suggests that the Board consider either December 2nd or December 9th for the next meeting. Staff is also recommending that the WCCTAC Board schedule a special one-hour meeting to discuss the STIP program (see item 16) and CCTA’s recommended Financing Plan for Measure J Projects. This meeting will need to take place prior to the November 16th CCTA Board meeting.
Staff Recommendation: No recommendation; Board action as appropriate.
14. FY 04-05 Financial Statements and Audit– Staff and Bradley Ward, WCCTAC Treasurer – HANDOUT – 15 minutes
ACTION ITEM
Maze and Associates has completed the Financial Statements and Audit for FY 04-05. WCCTAC’s Treasurer, Bradley Ward, will make a short presentation and answer questions regarding the documents.

15. I-80 Freeway Congestion – Follow Up to the Discussion at the September 30th Board Meeting – Staff – ATTACHMENT – 10 minutes
ACTION ITEM
At the September 30th meeting, the Board discussed the traffic congestion on I-80 – which was reported (for the fifth year running) to be the most congested freeway in the Bay Area in the morning commute hours. Staff was directed to bring a draft “Op-Ed” piece to the October meeting for discussion and action, as well as to initiate planning for the next Transit Summit where solutions/mitigations would be highlighted.
Staff Recommendation: Review and comment on the Op-Ed piece; direct staff to distribute to the media and initiate planning for the Transit Summit.
16. 2006 State Transportation Improvement Program (STIP) – Staff and CCTA Staff - SEPARATE ATTACHMENT and HANDOUT – 15 minutes
ACTION ITEM
Information on the 2006 STIP – following discussion at the Contra Costa Transportation Authority’s (CCTA) Administration and Projects Committee (APC) is attached. The West County projects in the 2004 STIP (now the 2006 STIP) are recommended for funding as follows (see Separate Attachment for full details):
· Westbound HOV lanes from Highway 4 to the Carquinez Bridge – Full funding in FY 07.
· Richmond Parkway Transit Center – Full funding in FY 08 and FY 09 with RTIP and RM2 funds.
· Richmond BART Parking Structure – Full funding by FY 08 with RTIP, ITIP, TCRP, federal earmark, Measure C, and STP funds.
· Hercules Rail Station – Full funding by FY 08 with STIP RIP, TCRP, federal earmark, HIP funds, Measure J funds, redevelopment agency funds, and proposed West County developer fee funds.
The funding plans for West County projects have been discussed with the project sponsors and the following concerns have been raised:
1. TCRP funds are being shown for the Richmond BART Parking Structure and the Hercules Rail Station, however, there is still uncertainty in terms of whether or not these funds are viable. How will these projects remain fully funded if the TCRP funds are not available?
2. Developer fee funds for the Hercules Rail Station are on the list in the Draft Update of the Subregional Transportation Mitigation Fee Program (the “STMP”); however, the updated program has not been reviewed and approved by the WCCTAC member jurisdictions. Additionally, a prioritization process will have to be undertaken if the updated program is approved, since the fees will be collected over time.
Working with Vice Chair Viramontes (a member of the APC), a recommendation regarding potential full funding for the Richmond BART Parking Structure and the Hercules Rail Station will be provided at the meeting (HANDOUT).
Staff Recommendation: No recommendation; Board discussion and action as appropriate.
17. Subregional Transportation Mitigation Fee Program (STMP) – Review and Approval – Staff – SEPARATE ATTACHMENT – 15 minutes
ACTION ITEM
Background: In January 2005, the WCCTAC Board reviewed the draft Update to the STMP program (“Developer Fees”) and directed staff to move forward with presentations to the member cities and the County. Subsequently, during discussions of the Measure C Strategic Plan Update, two projects were approved to replace the El Cerrito BART Parking project. In order for a project to move forward in El Cerrito, the El Cerrito Del Norte Transit Oriented Development Project was added to the list of projects to be funded by the Developer Fees.
Recommendation: The latest version of the draft STMP Update is in the Separate Attachment. Still open for discussion is the issue of project oversight/management, since the Update includes eleven projects (versus three projects in the original Developer Fee program); a revised Cooperative Agreement; and a revised Ordinance. In order to expedite the process, staff is seeking reaffirmation to present the information to the WCCTAC cities and the County, and simultaneously finalize the administrative details of the program, the Cooperative Agreement, and the Ordinance. Staff will return to the cities/County for final approval with the Cooperative Agreement/Ordinance in early 2006.
Staff Recommendation: Direct staff to make presentations to the WCCTAC cities/County for approval of the Updated STMP, conditioned upon approval of the Cooperative Agreement and Ordinance at a later date; direct staff to finalize details of the program including the administrative details, Cooperative Agreement, and Ordinance.
18. Regional Traffic/Transportation Impacts of Potential Casino Projects in West County – Study – Staff – ATTACHMENT and HANDOUT – 15 minutes
ACTION ITEM
A Request for Proposals (RFP) was issued on October 3, 2005 for a “Phased Transportation Study for Proposed Urban Casinos in West Contra Costa County.” Responses are due on October 20th, and staff will report on the responses received, interviews held, and a recommendation (if available).
Staff Recommendation: Receive the information; action as appropriate which may include approving the Consultant to lead the Study.
19. Update on Bay Area Regional Rail Plan – Tom Matoff, Director of Transportation Planning for LTK Engineering Services and Malcom Quint, BART– ATTACHMENT and handout– 20 minutes
Tom Matoff will discuss the Bay Area Regional Rail Plan, the work of the Steering Committee, the scope of the Plan, timeline, and upcoming community meetings. There will be a fifteen-minute presentation and five minutes for questions/answers.
